Terms of Service (Service Agreement)

Company: Panda Med Consulting Co., Ltd. (“Panda Med”, “we”, “us”, “our”)
Service Scope: International clients seeking medical evaluation and care access in China.
1. Acceptance of Terms By purchasing, booking, accessing, or using any Panda Med service (the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Services.
2. Eligibility You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement. If you use the Services on behalf of another person (e.g., a family member), you represent that you have the legal authority to act on their behalf and to share their information with us.
3. Definitions
“Information Consultation”: A scheduled online session focused on education, care coordination, and medical navigation support.
“Report/PDF Summary”: Written informational output provided after the session when included in the purchased service.
“Third-Party Providers”: Hospitals, clinics, physicians, laboratories, imaging centers, translators/interpreters, travel/logistics partners, and any other third parties involved in your care access.
4. Nature of Services (Strictly Non-Medical & Non-Diagnostic)
Panda Med operates exclusively as a management consulting and care coordination firm. We are not a medical provider, hospital, or clinic. Our Services may include:
Educational information support (strictly non-diagnostic);
Medical records organization and summarization;
Translation and interpretation assistance;
Appointment coordination and logistics guidance for seeking medical evaluation in China.
We do not provide medical diagnoses, medical advice, treatment plans, prescriptions, emergency services, or “medical clearance to travel.” The Services are not telemedicine and do not establish a doctor-patient relationship. All medical decisions are made solely by licensed clinicians and hospitals.
5. Emergency & Urgent Care Notice
Panda Med’s services are not designed for medical emergencies or rapidly worsening conditions. If you believe you are experiencing a medical emergency, you must immediately call your local emergency services (e.g., 911 in the US) or proceed to the nearest Emergency Room.
6. How Services Are Delivered & Timelines
Services may be delivered via secure document sharing, email, video/audio calls, or other online tools we designate. The specific deliverables and estimated turnaround times (e.g., 3-7 business days for comprehensive case reviews) depend entirely on the specific service tier purchased. You agree to provide accurate contact information and supply all requested health documents in advance in the required format. All stated timelines are estimates and commence only after we receive all necessary and legible documents from you. Timelines may be extended due to document translation needs, extreme case complexity, time zone differences, Chinese national holidays, or the responsiveness of Third-Party Providers.
7. Client Responsibilities & No Guarantee of Outcomes
Medical outcomes are inherently uncertain. We do not guarantee treatment results, specific appointment availability, hospital acceptance of your case, or that any condition can be cured. You acknowledge and agree that you are solely responsible for:
Seeking appropriate medical care and confirming all clinical details directly with licensed clinicians.
Verifying critical information (e.g., diagnosis, treatment plans, medication names/doses, procedure risks).
Maintaining your own copies of medical records and travel documents.
Ensuring you have appropriate insurance or financial arrangements for your medical care and travel.
8. Payments, Cancellations, and Refund Policy
Due to the specialized, highly customized, and labor-intensive nature of our services (which involve immediate administrative coordination, cross-cultural document translation, and booking independent expert time), all fees paid to Panda Med are strictly non-refundable once the case review or coordination process has commenced. By purchasing a service, you acknowledge and agree that you are paying for the time, administrative expertise, and organizational labor of our team and the participating independent consultants, not for a specific medical outcome, diagnosis, or guaranteed hospital admission. If you wish to cancel an order, you must do so in writing before any document processing or coordination work has begun. Once work has initiated, no refunds will be issued under any circumstances.
9. Third-Party Providers & Direct Payments
You agree to pay all medical fees directly to the hospitals, clinics, or other Third-Party Providers. Panda Med does not collect medical fees on behalf of hospitals unless expressly stated in writing for a specific non-medical fee item (e.g., an optional logistics deposit). We do not control Third-Party Providers and are not responsible for their acts, omissions, availability, pricing, or medical outcomes.
10. Translation & Coordination Disclaimer
While we strive to provide accurate translation and logistical coordination, cross-cultural and medical communications can be complex. You acknowledge that miscommunications or translation errors can occur. You remain solely responsible for confirming all critical medical information, risks, and consent forms directly with your treating hospital.
11. Communications & Consent
You consent to receive communications from Panda Med related to service delivery (e.g., scheduling, document requests, confirmations) via email, phone, messaging apps, or other channels you provide. Standard message/data rates may apply.
12. Intellectual Property
All Panda Med materials (templates, summaries, guides, documents, website content) are owned by Panda Med or its licensors and protected by applicable laws. You may use deliverables for your personal use only and may not reproduce, resell, or distribute them commercially without written permission.
13. Suspension and Refusal of Service
We reserve the right to refuse, suspend, or terminate Services when reasonably necessary, including if:
You provide false or misleading information;
You misuse the Services, harass our staff, or request illegal/unsafe actions;
We believe your situation requires immediate emergency or in-person urgent care;
Compliance risks, international sanctions, or legal restrictions apply.
14. Travel and Cross-Border Risks
Cross-border medical evaluation and travel involve inherent risks that are beyond the control of Panda Med. These include, but are not limited to: changes in visa or entry policies, infectious disease exposure, flight delays or cancellations, and differences in international medical practices, languages, and data protection standards. You assume all responsibility and risks associated with international travel. Panda Med is not responsible for any delays, complications, or financial losses related to your travel arrangements.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Panda Med is not liable for any diagnosis, treatment, medical advice, or outcomes provided by Third-Party Providers, nor for any travel-related risks or financial losses. If Panda Med is found liable for any reason under law, our total aggregate liability shall not exceed the amount you paid directly to Panda Med for the specific service giving rise to the claim.
16. Force Majeure
Panda Med is not liable for delays or failures in service delivery caused by events beyond our reasonable control, including but not limited to natural disasters, epidemics, internet outages, government actions, hospital policy changes, strikes, or travel restrictions.
17. Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
18. Governing Law and Dispute Resolution
These Terms, and any updates to them, are governed by the laws of the People’s Republic of China. Any dispute arising from or in connection with these Terms shall be submitted to the competent people’s court in Beijing China.
